01The service and its operator
EuropeTrainPics is operated by Tristan Schelkens, a private individual based in Belgium. Contact support@europetrainpics.com for service questions, legal notices and complaints.
These Terms cover the EuropeTrainPics website, iOS app, photo archive, profiles, comments, topics, private messages and our connected Discord bot/community features. Apple and Discord have separate terms for their own services.
When registering, you are asked to accept these Terms. The Privacy Policy explains personal-data processing; acknowledging that notice is not blanket consent to optional processing. Mandatory rights continue to apply.
02Age and accounts
You must be at least 13 years old to hold an account, or older where applicable local law requires it. Accounts for children under 13 are not permitted. If local law requires parental authorisation for a minor's agreement or relevant processing, that authorisation is also required. Discord users must independently meet Discord's country-specific minimum age.
Use an email address you control and accurate information where requested. A public username can be a pseudonym, but must not impersonate someone. Keep credentials confidential and report suspected misuse. You are responsible for your own actions, not automatically for every unauthorised act committed against your account.
Do not evade bans, misuse another account, collect other people's credentials, or attempt unauthorised access. If you discover a vulnerability, report it privately without accessing, copying or disclosing other people's data.
03Your content and our limited licence
You keep ownership of your photos and other content. Upload only material you created or have permission to share, including the permissions needed for the uses described here. Respect copyright, privacy, image rights and confidentiality.
For all content you submit, you give us a non-exclusive, worldwide, royalty-free licence to store, process, reproduce, resize, format and display it only as needed to provide the feature and its chosen audience, moderate it, and meet lawful obligations. Necessary technical providers may process it for those purposes.
For approved photos submitted to the public archive, the licence also allows promotion of EuropeTrainPics and reposting on its official social-media accounts, including Instagram, without asking separately for each repost. We will credit the submitted account name where reasonably possible. Technical presentation changes must not falsely attribute or materially misrepresent your work.
This promotional permission does not cover private messages, private attachments or non-public album content. We do not acquire ownership, sell your photo as a standalone work or license it to unrelated parties for their independent use without further permission.
You can ask us to stop future promotional use and request removal of existing official reposts. We will assess and act on lawful removal requests; copyright licensing does not override privacy rights. When content is removed, the licence ends except as necessary to complete removal, maintain lawfully retained restricted records or meet legal obligations. Copies made independently by other people may be outside our control.
Provide accurate railway details where reasonably possible. Public archive submissions may require approval. Approval is not a guarantee that information is correct or that all third-party rights have been cleared.
04Community rules and railway safety
- Be respectful. No harassment, threats, hate speech, scams, spam, impersonation or targeted abuse.
- No sexual exploitation, child sexual abuse material, non-consensual intimate imagery, sexually explicit content, unlawful material or encouragement of violence or self-harm.
- Do not expose private personal information, upload stolen work, spread malware, manipulate engagement or deliberately disrupt the service.
- Observe railway, station and local safety rules. Do not trespass, enter restricted tracks or depots, train-surf, or endanger yourself or others to obtain content.
- Respect people shown in photos. Avoid disclosing home addresses, sensitive locations, staff details or identifying information without a lawful justification.
These rules apply to profiles, media, comments, topics, private messages and connected community activity. Reports and appeals must be made honestly; an unsuccessful good-faith report is not itself abuse.
05Messages, replies and notifications
Conversations are intended for communication between members, not emergencies or confidential recordkeeping. Private messages are not end-to-end encrypted against the service operator. The Privacy Policy explains access and visibility.
Where offered, the delete-message control is available for 15 minutes after sending. Deletion can leave a dated deletion notice or a reference in a reply. The interface's time limit does not remove statutory data-protection rights.
Hiding or swiping away a conversation removes it from your list, not its stored history. Notifications and recipients' copies may already have been seen or saved; we cannot promise to retract every copy after deletion.
06Moderation and appeals
We use human review of submissions and reports, supported by automated text checks. A check may flag or reject content; it is not proof that content is unlawful. Owners and authorised moderators may review material necessary to handle reports and enforce these rules.
Possible actions include correcting metadata, rejecting submissions, removing or limiting content, issuing warnings, or temporarily or permanently restricting an account. Decisions should take account of seriousness, context, repetition, safety and users' rights. Urgent restrictions may be necessary to prevent immediate harm.
Use Community safety or the in-app Report / block controls. Blocking hides the person's community content for you and prevents private messages; the current block flow also sends a report to moderators.
Where we restrict your content or account, we will provide reasons and available challenge options as required by law, unless disclosure is legally restricted. To appeal, email the content/account identifier, decision and your explanation. You can ask for human reconsideration. Legal complaint and court options remain available.
07Reporting illegal content or copyright infringement
Send a report to support@europetrainpics.com or use the available reporting controls. To help us locate and assess it, include:
- The exact URL, content identifier or conversation/message details.
- Why you believe it is illegal or violates these Terms, with relevant context. For copyright, identify the work and explain your authority to act.
- Your name and email so we can respond, except where the law permits a report without them.
- A statement that you genuinely believe the information in your report is accurate and complete.
Do not download, forward or attach suspected child sexual abuse material. Report its location instead. For immediate danger, contact the appropriate emergency services; this service is not an emergency channel.
We will assess sufficiently specific notices, communicate decisions as required and take appropriate action. Relevant evidence may be preserved where necessary and lawful. Reports are not published as community posts, but absolute confidentiality cannot be promised where disclosure is legally required.
08Information, points and third-party services
Railway details, maps, news and automated or AI-assisted suggestions may be incomplete, outdated or incorrect. Check important information against authoritative railway sources. Do not rely on the app for operational railway instructions or safe access to railway property.
Community points, badges and challenges are participation features, not money or a promise of a prize. Any prize promotion needs its own clearly stated rules. External links are not an endorsement, and third-party services remain subject to their own terms.
These Terms do not authorise an undisclosed charge or subscription. If paid features are introduced, prices, billing and applicable cancellation/consumer rights must be disclosed before purchase. Optional advertising or marketing processing requires the information and choices required by law.
09Availability and ending your account
We aim to provide a reliable service, but outages, maintenance and necessary changes can occur. We will give reasonable notice of material changes or discontinuation where practicable, except where security or legal needs require urgent action. Mandatory obligations and consumer remedies still apply.
You may stop using the service and request deletion through Settings, the deletion instructions or email. Uninstalling the app or leaving Discord does not delete your EuropeTrainPics account.
We may restrict or end access for serious or repeated breaches, security risks or legal requirements, subject to proportionate decision-making and applicable notice/appeal rights. Retention and erasure are explained in the Privacy Policy; account deletion is not a guarantee that every separately stored file or log is immediately erased.
10Responsibility and your legal rights
You remain responsible for content you knowingly submit and for respecting others' rights. We remain responsible for our own obligations under applicable law. We do not guarantee the accuracy of user content or uninterrupted availability.
Nothing in these Terms excludes liability that cannot lawfully be excluded, including applicable liability for intentional misconduct or gross negligence, or removes mandatory consumer and data-protection rights. These Terms do not require you to indemnify us for every claim or waive rights arising from our own conduct.
Belgian law governs these Terms, without depriving consumers of mandatory protections that apply in their country of habitual residence. Any competent court and legally available complaint or dispute-resolution route remains available; there is no mandatory private arbitration or exclusive Belgian-court requirement here.
11Changes and contact
We may revise these Terms for legal, security or service changes. We will identify the revision date and give appropriate advance notice of material changes where required. Where renewed agreement is required, we will request it. A change does not retrospectively remove accrued rights or expand a content licence beyond what was validly agreed.
If a provision is unenforceable, the remaining provisions continue only to the extent permitted by law. Contact support@europetrainpics.com with questions or complaints.
